Network Terms and Conditions
The Health and Wellbeing Network IW is operated by Nova Lifestyles Ltd. Its registered office is at 1, Wilmington Mews, Appley Rise, Ryde, Isle of Wight, PO33 1LE, Company Registration No: 6689954. Through the Network you may gain access to the products and services of Nova Lifestyles Ltd. In addition to these terms and conditions the provision of such products and services may be governed by additional terms and conditions as you may be made aware of at the time of ordering/using.
We may suspend and/or terminate (either in whole or in part) your membership of the Network if our terms and conditions are breeched. Nova Lifestyles Ltd. reserves the right to assign or transfer all or any of its rights and obligations under these terms and conditions to any of its group companies or to any other third party. In the event of assignment or transfer, notification will either be given to you by e-mail or post.
Failure by Nova Lifestyles Ltd. to exercise or enforce any right conferred upon it shall not be deemed to be a waiver of any such right nor operate so as to bar the exercise or enforcement of that or any other right on any later occasion. Nova Lifestyles Ltd. reserves the right to vary these terms and conditions from time to time. Such changes will either be notified to you by e-mail or posted to you. Changes in this manner shall be deemed to have been accepted if you continue to participate in the Network.
These terms are governed by and will be interpreted in accordance with English law. The English courts shall have exclusive jurisdiction to settle any claim or dispute which may arise out of or in connection with these terms and conditions. Nova Lifestyles Ltd. endeavours to ensure that the information it provides via the Network is accurate and accepts no liability for any errors and omissions, or misuse of copyright or personal information in breach of its terms and conditions. Nova Lifestyles Ltd. does not accept any liability for views, opinions or advice expressed by network members and which are not necessarily shared by Nova Lifestyles Ltd.
Nova Lifestyles Ltd operates an equality and diversity policy that applies to all its activities and operations. We will treat all network members with respect and value their contribution and equally we expect all members to acknowledge and respect the views, values and judgements of others.
Network members whilst able to benefit from the services and support provided by the Network cannot at any time confer their own views, opinions and judgements as necessarily being those of the network and no individual member has the authority to represent the Network unless such authority is directly given to it by Nova Lifestyles Ltd or the Network appointed Governing Committee. Network members whilst engaged upon Network connected activity or duties must maintain the professional standards expected or not bring the network into disrepute. Actions deemed to be in breech of this may lead to immediate expulsion from the Network.
Our privacy policy applies to any information acquired by and/or provided Nova Lifestyles Ltd including but not limited to:
- information provided through use of the Network and its support services;
- information provided during the course of network activities, events and meetings;
- information provided through enquiries or by the completion of any request and or invitation for information.
Nova Lifestyles recognises that your privacy is important to you. The information you submit to us will be kept confidential and secure once received. The information will be processed by Nova Lifestyles or on its behalf under strictly regulated conditions in accordance with the provisions of the Data Protection Act 1998. Any personal information provided by you to or obtained from other sources by Nova Lifestyles Ltd. will only be used for the following purposes:
- updating and enhancing customer, contact and membership records and those of other related Nova Lifestyles Ltd. activities;
- compiling information relating to your use of the Network, its products and services and defining areas of interest to you;
- handling orders, delivering products and services, processing payments, communicating with you about orders, products and services and generally maintaining your membership account;
- advising you of other products and services which may be of interest;
- inviting you to participate in research studies and/or market research activities.
Nova Lifestyles Ltd.will only disclose this information in the following circumstances:
- where your consent has been obtained;
- where there is a legal obligation;
- where there is a public duty; and
- in connection with the assignment or transfer of all or any of its rights and obligations to any of its group companies or to any other third party.
For operational reasons and/or in order to meet specific requests, data may also be processed on behalf of Nova Lifestyles by external organisations under strictly regulated conditions in accordance with the provisions of the Data Protection Act 1998.
Nova Lifestyles Ltd.will take reasonable steps to create an accurate record of any personal data you have submitted. However, Nova Lifestyles Ltd. does not assume responsibility for confirming the ongoing accuracy of your personal data. You can update your personal data by submitting amendments to us either by e mail or by post.
Any modifications to the privacy practices of Nova Lifestyles Ltd. will be issued to you and if there is a material change in our privacy practices, we make the necessary amendments to membership terms and conditions. If Nova Lifestyles Ltd. considers using the information collected from you in a manner materially different from that stated at the time of collection, we will send written notice by email of the change.
By disclosing personal information to Nova Lifestyles Ltd. you consent to the collection, storage and processing of information in the manner described in this document. Please note that your continued use of the Nova Lifestyles Health and Wellbeing Network and/or products and services constitutes your agreement to any changes to this policy and the terms and conditions of use.
All intellectual property rights contained in materials relating to the Nova Lifestyles Health and Wellbeing Network and information published by Nova Lifestyles or within any of its services and products remain within the copyright of Nova Lifestyles or licensed to it.
Save as may be incidental to you obtaining authorised access to membership material, you must not reproduce, download, transmit or retransmit, manipulate or store on paper or on any other format in whole or in part the design, layout or content of information or material provided by Nova Lifestyles Ltd., without our prior written consent, such permission to be given or withheld at Nova Lifestyles Ltd absolute discretion.
Nova Lifestyles Ltd. does not warrant or represent and excludes all warranties or representations that the material and information, including advertising material, within the Network is accurate, true or complete. In no circumstances will Nova Lifestyles Ltd. be liable to you or any other third parties for any loss or damage (whether direct or indirect, including loss of profits, loss of opportunity or any consequential loss) resulting from or in any way connected with your membership of the Network, whether caused by negligence, misrepresentation, breach of any statutory duty, or breach of contract or otherwise. Nova Lifestyles Ltd. does not limit or exclude its liability for death or personal injury resulting from its negligence. Any contact made, negotiations or contractual agreements made between individual members of the Network is made entirely at your own risk.
You agree to indemnify and to keep Nova Lifestyles Ltd. indemnified from and against any costs, claims, demands, expenses and liabilities suffered or incurred by Nova Lifestyles Ltd. arising from or which is directly or indirectly related to your membership of the Network.
